Jonathan Cutler is a Senior Counsel in the Intellectual Property Group. An Attorney and Patent Agent in both Canada and the United States, he specializes in patents and industrial designs on both sides of the border. As part of his practice, he negotiates and drafts agreements related to patents, provides patent opinions, acts in contested matters, and prepares and files patent applications, in Canada, the United States and abroad.
Having almost 25 years of experience in patents, Jonathan provides clients with advice on wide array of international patent matters, including: global patent strategy, corporate patent operations, patent portfolio development, patent procurement, freedom-to-operate, value generation, patent licensing, patent enforcement and contested patent matters.
He handles matters involving design and manufacturing, protection of and freedom-to-operate for products for multi-territorial distribution. His knowledge and experience allow him to understand the complex legal and patent issues involved to assist clients in achieving their business objectives.
During his career, he has prepared and filed numerous patent applications, most often in the United States, the European Patent Office and the State Intellectual Property Office of China. Being a registered U.S. Patent Attorney, he has also prepared many opinions concerning the validity and infringement of U.S. patents.
Jonathan has acted in contested matters before the United States Patent & Trademark Office, including interferences, re-examinations and reviews, as well as having managed a number of American patent litigation cases.
Jonathan has significant experience working on intellectual property aspects of corporate transactions, corporate finance and corporate due diligence.
He is also a Professional Engineer and is familiar with broad range of technologies, including dental and medical devices, vehicles, energy and renewable resources, software and artificial intelligence.
Prior to joining Fasken, Jonathan had practiced at an intellectual property boutique, an international corporate law firm, and a Canadian business law firm, where he was co-Chair of the firms’ Intellectual Property department. Jonathan was also for a number of years Director of Intellectual Property at Bombardier Recreational Products Inc., where he was responsible for all of the company’s intellectual property matters worldwide, as well as implementation, training and management of the company’s global IP staff and operations.
