Kelly is a lawyer practicing in intellectual property and life sciences litigation. She represents and advises firm clients in patent matters to protect their intellectual property. She has appeared before the Federal Courts in proceedings under the Patent Act and Patented Medicines (Notice of Compliance) Regulations.
Kelly brings practical experience in both Federal Courts litigation and the life science industry to her practice.
Her Federal Courts litigation experience includes representing pharmaceutical clients before the Federal Court and Federal Court of Appeal in matters under the PM (NOC) Regulations and the Patent Act.
She also served as a judicial law clerk for two years working with judges and prothonotaries at both the Federal Court and Federal Court of Appeal on matters including those under the Patent Act, the PM (NOC) Regulations, the Copyright Act, and the Trade-marks Act.
Her life sciences experience includes subject matter expertise in cellular and molecular biology and knowledge of the Canadian regulatory approval landscape for life sciences industry products.
Kelly also holds PhD and MSc degrees in cell and molecular biology. Through her research she collaborated and worked with both basic researchers and clinicians in cancer, genetics, neuroscience, stem cells, and fertility.
Her knowledge of the Canadian regulatory environment comes from working at the Health Products and Food Branch of Health Canada advising three different levels of management as a Senior Advisor to the Assistant Deputy Minister of the Health Products and Food Branch, Senior Advisor to the Director General of the Therapeutic Products Directorate, and Associate Director in the Bureau of Pharmaceutical Sciences.
Prior to joining Fasken, Kelly worked as in-house counsel at a large Canadian pharmaceutical company in intellectual property and general litigation management.
