“Although the SEC was collecting an impressive number of convictions for insider trading, tipping and securities fraud in the 1990s and 2000s, the OSC was not. Coupled with the legal and political setback of leading an unsuccessful attempt to establish a national securities regulator, the effectiveness of enforcement efforts of the OSC was openly and publicly questioned. A new approach was required to regain the respect of the capital markets and the public,” writes Keith, a partner with Fasken Martineau and co-founder of the firm’s White Collar Defence and Investigations practice group.
