Droit-Inc quotes Montréal Lawyer Nikolas Blanchette in an article on the decision rendered in the Jennifer Lawrence case.

Mtres Sébastien Fiset, founding partner of the firm Fiset Légal, and Nikolas Blanchette of Fasken Martineau, first questioned by Droit-Inc when this matter began, comment again, this time in light of the decision rendered in this case a week ago.

“The clause prohibiting short-term rentals was interpreted in a way that did not prevent the defendants from occupying the building for a term less than 12 months,” explained Mtre Blanchette. “The Court distinguished between “renting” and “occupying” co-owned units. The clause in dispute did not prohibit a temporary occupation, as opposed to renting for a period less than 12 months.”
