The Wire Report quotes Ottawa lawyer Jay Kerr-Wilson in an article about the notice-and-notice regime and its effect on piracy ahead of the federal government’s review of the Copyright Act.

“’Jay Kerr-Wilson, a copyright lawyer with Toronto-based Fasken Martineau DuMoulin LLP, said in an email that he is “not aware of any attempts to measure
the impact of the [notice regime] on… incidents of online infringement.’”

“Kerr-Wilson said that rights-holders have used it to, in a sense, ‘extort’ money from subscribers by including links in the notices to where subscribers can settle for thousands of dollars and have misrepresented penalties under Canadian law.”
