"Canada: Facebook decision “serves as a warning” to companies relying on forum selection clauses" by Kaveh Lahooti, Dataguidance.com.

DataGuidance.com quotes Toronto Lawyer Alex Cameron in an article about companies relying on forum selection clauses.

Alex Cameron, Partner at Fasken Martineau LLP, told DataGuidance, “This case is one of a growing number of privacy-related class actions in Canada, but is one of the few privacy class actions that deals with privacy practices in the ordinary course of business. The decision of the Supreme Court may serve to encourage plaintiffs’ counsel to file similar cases, particularly in relation to online advertising activities. The decision also serves as a warning to organisations that the forum selection clauses they may have been counting on may not be enforceable after all.”
