He regularly handles complex insurance problems, including those arising from mergers and acquisitions, corporate insolvency and reorganization, and large mining and industrial risks and losses, and litigation cases requiring assessment of opposing parties’ insurance coverage. His clients’ successes have produced leading British Columbia decisions on the duty of liability insurers to provide independent defence counsel to their insureds, when foreign insurers must accept local law and jurisdiction, and coverage for defamation and unfair competition liabilities. Richard also advises clients and assists other firm lawyers with contract provisions for insurance coverage, risk allocation, and indemnity.
Richard represents numerous high-profile companies on their insurance matters including Toyota Canada, Cloudworks Energy, and PricewaterhouseCoopers.
He appears before the British Columbia courts and the Supreme Court of Canada, and is a frequent speaker and author at continuing legal education seminars on data breach issues and limitation of liability clauses (releases and waivers) and indemnities in commercial contracts.
