On April 20, 2006, the Ontario Energy Board ("OEB") awarded over $1 million plus legal costs to Sifto Canada Corp. after rehearing a 2001 rate application.
As a result of this decision, Ontario energy utilities may wish to consider altering their approach to rate applications in the following manner:
notifying large energy customers of rate applications directly, rather than relying on customers to take note of the legislatively required newspaper notice
utilities must ensure that rate applications before the OEB are updated as information material to a completed rate application comes to utility's attention
