On April 2, 2009, Victoria Park Limited Partnership and Victoria Park Holdings Ltd., developers of a condominium complex in Calgary, made an application for protection under the Companies' Creditors Arrangement Act and an Order was granted by the Honourable Madam Justice C.A. Kent of the Court of Queen's Bench of Alberta, and PricewaterhouseCoopers Inc. (PwC) was appointed Monitor. HSBC Bank Canada was the principal secured lender and ultimately appointed PwC as Receiver to realize its security. On March 15, 2010, Justice Kent approved a sale of the project. Fasken Martineau advised HSBC in these proceedings with a team led by John Grieve and including, among others, Rinus de Waal, Gary Rose, Michael Loberg and Vicki Tickle.
