Performance Based Regulation, or PBR, is an alternative rate structure for public utility rate regulation. In BC, public utilities are regulated by an expert administrative tribunal called the BC Utilities Commission. The applicant FortisBC utilities are a gas utility serving over 900,000 customers, and an electric generation, transmission and distribution utility in central BC. FortisBC was seeking to set formula-driven electric and natural gas rates for five years. The proceeding involved thousands of information requests, multiple interveners, an oral hearing lasting a number of days, and written and oral argument. Matt was involved as lead counsel throughout the proceeding, and cross-examined various experts.
