Fasken represented Vancouver City Savings Credit Union in a class action brought against various financial institutions and others arising from an investment scheme operated by a notary. We were successful on an appeal to the B.C. Court of Appeal in having the plaintiffs’ application for certification dismissed. We successfully argued that the judge erred in finding that the pleadings disclosed a cause of action in conversion against our client, and in concluding that the claims pleaded against our client raised common issues.
