A Fasken Martineau team successfully pleaded before the Court of Appeal of Québec in a landmark decision on investigation orders and provisions for costs under the Canada Business Corporations Act. Writing on behalf of the Court, the Honourable Clément Gascon reversed the trial court’s decision to grant a provision for costs and an investigation. The Court noted that detailed evidence is required to obtain a provision for costs. The Court also stated that a cost-benefit analysis should be conducted before ordering an investigation.
