This matter involved an application for a stay of proceedings due to unreasonable delay and denial of a fair trial in an occupational health and safety matter where charges had been laid against Black & McDonald following a workplace incident where a worker was injured.

The application was brought on the basis of breaches of section 11(b) and 11(d) of the Canadian Charger of Rights and Freedoms due to significant issues with delays in getting this matter to trial, and with provision of disclosure.
Fasken advised Black and McDonald with a team including Norm Keith and David Marchione.
