Newfoundland and Labrador Hydro (NLH) needed representation in a hearing before the Québec Energy Board in the context of the network upgrade policy revision hearing, as part of the Hydro-Québec Open Access Transmission Tariff. There was an important monetary aspect to this file, with a value of $3 billion, since there is an issue concerning acquired rights for some electricity market participants.

The Québec Energy Board rendered its decision in Winter of 2016. Fasken then represented NLH in the context of the judiciary rehearing before the Québec Energy Board in spring of 2017. The Québec Energy Board decision was rendered in fall of 2017. The hearing of Phase 2 of this file took place in 2019.

A Fasken team lead by André Turmel including Emilie Bundock represented NLH and Nalcor Energy Marketing Corporation (NEMC) (representing one of its subsidiary Newfoundland and Labrador Hydro) connection with this matter.
