Defence counsel made an application for a stay of proceedings for unreasonable delay. Judge Gregory E. Lenehan found the delay not unreasonable and under the presumptive ceiling established by the Supreme Court found that the defendant’s rights under subsection 11(b) and 11(d) of the Charter were not violated.
