Sandoz is a generic drug manufacturer. Sandoz was sued, along with Takeda and Apotex, in a putative class action relating to the name brand drug, Actos, and its generic equivalent, Pioglitazone. The drug is designed to treat Type 2 diabetes. The plaintiffs allege that it has an undisclosed adverse side effect of causing bladder cancer. The defendants firmly deny this allegation, and substantial expert evidence ins support of the defendants’ position was filed with court for the certification motion, which has not yet been heard. This matter is important because, among other things, the two generic defendants have raised issues resecting novel defences to the “failure to warn” claim.
