Mark is the Chair of Fasken’s BC Commercial Litigation group. Joining Russell & DuMoulin in 1983 he learned from some of the legends of the BC bar and has for many years been a leading trial and appellate counsel. He takes on bet-the-farm cases with the focus, determination, skills and team to deliver what clients need. Appointed Queen’s Counsel in 2004, he is a Fellow of the American College of Trial Lawyers and the International Society of Barristers.

The Fasken’s BC litigation department is widely acknowledged to be the pre-eminent major firm dispute resolution group in BC. Mark works with partners and associates of the highest quality and experience who together litigate and resolve many widely diverse cases, using a business-oriented, cost-effective approach, backed up by genuine litigation horse power. 

Mark has been counsel in over 150 cases decided by the BC Courts, including over 60 in the Court of Appeal, together with many arbitrations, both domestic and international. Recent experience includes acting as lead counsel for BC Hydro in the successful defence of numerous challenges brought against the Site C Project on environmental, aboriginal and administrative law grounds in the BC and Federal Courts.  He regularly litigates corporate and commercial cases including the Icahn v. Lions Gate case, which is one of the leading cases in BC on the oppression remedy. He acts in regulatory and professional discipline cases.  He is an active arbitrator and mediator and resolves many cases through mediation.

Mark was the co-chair of the UBC Allan McEachern Advanced Trial Advocacy course for many years and regularly teaches and lectures on trial and appellate advocacy and commercial litigation topics.
