Matthew (Matt) Ghikas is a partner in the Litigation and Dispute Resolution Group. He is a highly ranked lawyer and an expert in the energy and natural resources industries. Matt represents clients in administrative proceedings, litigation before the courts in BC and Alberta, and in arbitrations and mediations. Matt appears before regulatory tribunals such as the British Columbia Utilities Commission, Alberta Utilities Commission and the Manitoba Public Utilities Board on a frequent basis on behalf of regulated clients.

Expertise in Energy Regulation and Administrative Law

Matt has considerable experience in representing regulated companies in a wide variety of regulatory-related matters, including:

  • Revenue requirements applications
  • Capital project permitting and approvals (e.g. CPCNs / Permits & Licences)
  • Environmental assessment processes
  • BC Oil & Gas Commission processes 
  • Rate design
  • Performance-based regulation (PBR)
  • Cost of capital/return on equity (ROE)
  • Pipeline decommissioning and abandonment under provincial regulations and the National Energy Board (NEB) Act
  • Compliance with mandatory electric reliability standards (MRS)
  • LNG export license applications

Understanding of Utility, Pipeline, Transportation, and Insurance Industries

Matt’s clients in regulatory matters include the largest natural gas utility in British Columbia serving approximately 950,000 customers, BC’s government-owned electric utility serving most of the province, the other large investor-owned electric distribution utility in BC, a LNG facility owner, electric transmission companies in British Columbia and Alberta, provincially-regulated and NEB-regulated pipeline owners, a thermal energy utility, the sole provider of regulated universal compulsory automobile insurance in British Columbia, and a provider of regulated ferry services.

In advising clients on regulatory matters, Matt combines a strategic approach to complex, multi-party litigation with subject matter expertise regarding the role of regulation and the energy industry. Matt understands that regulated entities have long-term relationships with regulators and other stakeholders, and appreciates the importance of a broader corporate regulatory strategy that recognizes this reality.

He prides himself on providing practical day-to-day advice that assists clients in achieving their business objectives. Matt favours a team-based approach. His subject matter expertise regarding regulated businesses and the energy industry enables him to participate seamlessly in cross-disciplinary project teams that include accountants, engineers, economists and scientists.

Energy Arbitration, Rate Arbitration and Commercial Arbitration

Matt has experience with international gas pricing and LNG pricing arbitrations, including claims under hardship clauses. He has experience in rate arbitrations in the railway industry, and commercial arbitration generally. Matt serves as a roster arbitrator with the International Centre for Dispute Resolution (American Arbitration Association) for hearing international and domestic arbitrations. He holds a Member (MCIArb) designation from the Chartered Institute of Arbitrators in London, UK in International Arbitration, and a Qualified Arbitrator (QArb.) designation from the ADR Institute of Canada in domestic arbitration.
