National Gallery of Canada wins US$8.7 million CITT procurement case

The National Gallery of Canada issued an Invitation to Tender for the replacement of the glass roof in the Great Hall of the Gallery. The value of the project was over $8.7 million. The timely completion of the project was of great importance to the Gallery so that disruption to visitors was minimized. One of the unsuccessful bidders challenged the procurement process before the Canadian International Trade Tribunal (CITT). The CITT dismissed the application. In its decision, the CITT relied on, among other things, procurement and commercial law, the Agreement on Internal Trade and the WTO Agreement on Government Procurement. The National Gallery retained Fasken Martineau, with a team led by Peter Mantas and Leslie Milton, and supported by Yael Wexler, to respond to the application.
