Public body created a novel process for commodified platform-as-a-service and infrastructure-as-a-service offerings from pre-qualified vendors to allow for broad public sector adoption of standardized approach and form for multi-party agreement.
Fasken worked with the agent to lead the legal and business team in ideation and development of this novel approach to incorporate ‘vendor-side’ concerns with regulatory procurement requirements, data sovereignty issues, and typical Canadian public sector concerns into a single form of agreement to be adopted throughout the sector to acquire PaaS and IaaS.
Fasken further advised the client’s team on key business and legal issues and risks associated with PaaS and IaaS solutions. Karam led the legal team in advising on structuring the arrangement, internal cooperation among various legal departments, SLA metrics and remedies, security and audit matters and limits on liability.
