A leading provider of an end-to-end cloud commerce platform successfully obtained an Anton Piller order against its former employee. This legal action was taken following the former employee's abrupt resignation and subsequent discovery of unauthorized downloads of confidential data.
The internal investigation revealed that the former employee had downloaded and stored tens of thousands of confidential files on external devices prior to resignation. This breach posed a significant threat to the company’s security certifications, which are crucial for servicing their clients, including major financial institutions and telecommunications companies.
The Anton Piller order, an extraordinary form of injunctive relief, allowed the company to search the former employee’s residence and seize evidence. The execution of this order, overseen by Independent Supervising Solicitors and Bailiffs, resulted in the recovery of tens of thousands of confidential files and numerous pieces of computer equipment.
This legal action was critical in mitigating the potential damage to the company’s operations and client trust, ensuring the protection of sensitive information and maintaining their industry certifications.
Fasken advised the company with a team that included Chris Semerjian (Litigation) and Claudie Fréchette (Litigation).
