Grounds for the refusal of access to the records of private bodies in terms of PAIA

Overview

The Promotion of Access to Information Act 2 of 2000 (PAIA) promotes transparency, accountability and effective governance of private bodies; and establishes voluntary and mandatory mechanisms to give effect to the right of access to information enshrined in the Constitution of the Republic of South Africa, 1996.

Private Companies and Directors of Private Companies should be mindful of the information that is protected from disclosure under the provisions of PAIA, the circumstances under which such protected information may be disclosed based on the public interest in such information and the consequences of failing to respond to requests for information within the stipulated time period.
