Overview

As family structures become increasingly complex, so to do the legal issues that arise in estate litigation.

This webinar will examine the evolving definition of “dependant” and the challenges posed by non-traditional claimants, including the rights of common law spouses seeking dependant relief from an estate and the legal implications of multi-parental arrangements, where a child may have more than two parents and potentially claim against multiple estates. We will also explore posthumous claims brought by secret or estranged children, often unknown to the family until after the deceased’s death, including a child’s claim as creditor for unpaid child support. For practitioners, the session will address important considerations such as limitation periods and litigation costs when advising estates or potential claimants.
