Innovation in the pharmaceutical, biotechnology, and medical device sectors requires a proactive intellectual property strategy. Building effective patent portfolios must not only comply with legal requirements regarding patentability but also take into account the stringent regulatory framework governing the authorization, sale conditions, and pricing of certain products in Canada.
In this context, the Fasken Institute offers the Life Sciences Patent Strategies training session, which aims to provide a solid foundation for developing intellectual property strategies tailored to this regulated environment.
This session addresses the challenges involved in developing patent strategies in the pharmaceutical, biotechnology, and medical sectors, taking into account the regulatory landscape in Canada. Among other things, it addresses the role of regulatory authorities, including Health Canada, which is responsible for approving the market launch of medical products and devices, as well as the Patented Medicine Prices Review Board, which oversees the retail prices of drugs protected by Canadian patents.
Overview
The presentation will begin with a review of patent fundamentals, including:
- their definition;
- the patent filing and grant process; and
- the rights that arise from them.
Next, we’ll talk about:
- the regulatory bodies and applicable regulatory requirements;
- the impact of these requirements on businesses.
Finally, the training session will offer insights into the development of integrated intellectual property strategies—particularly with regard to patents—taking into account the specific legal and regulatory requirements of the life sciences sector.
