Overview

Federally regulated employers face increasingly demanding regulatory obligations in connection with preventing, addressing, and investigating workplace harassment and violence under the Work Place Harassment and Violence Prevention Regulations. At the same time, reprisal complaints under the Canada Labour Code (CLC) continue to present significant legal and operational challenges for employers.

In this webinar, we will provide a practical overview of the legal and regulatory requirements that apply to employers when workplace harassment or violence complaints arise, including required prevention measures, reporting obligations, the prescribed investigator appointment process, and post-investigation obligations.

We will also share practical guidance for employers conducting workplace investigations in-house, with a focus on ensuring that investigations are thorough, procedurally fair, and legally defensible.

Finally, drawing on recent case law, we will examine common issues that arise in reprisal complaints under section 147 of the CLC and highlight key takeaways to help employers mitigate risk and respond effectively.
