On October 5, 2026, merchants and manufacturers operating in Québec will have to comply with the new regulation governing the legal warranty of good working order that applies to certain categories of new goods. The regulation follows the adoption of the Act to protect consumers from planned obsolescence and to promote the durability, repairability and maintenance of goods (“ Bill 29 ”) in October 2023, which introduced significant amendments to Québec’s Consumer Protection Act.
Given the numerous requirements under this new regulatory framework, proactively understanding the applicable obligations is crucial for anticipating the necessary adaptations and ensuring compliance once it comes into force.
As a result, the training will provide a clear and practical overview of the new warranty of good working order as well as the regulation published on December 17, 2025, which clarifies the warranty’s duration, the goods covered, and the disclosure obligations imposed on merchants and manufacturers, including before signing a contract that includes an additional warranty.
It seeks to give affected organizations a clear understanding of their new obligations, highlight key practical issues, and help reduce the risk of disputes arising from the implementation of this warranty.
Among the topics to be covered:
- the new legal warranty of good working order introduced by Bill 29, including its scope, the goods covered, the minimum warranty periods and its interaction with existing legal warranties
-
the obligations of merchants and manufacturers operating in Québec, particularly with respect to repairs, the scope of warranty coverage (parts, labour, exclusions) and how the warranty applies to subsequent purchasers
- the disclosure obligations applicable to merchants before offering a consumer a contract that includes an additional warranty on a good covered by a legal warranty
- the practical impacts and risks associated with implementing this warranty, including claims management, penalties for non-compliance and measures to ensure compliance
