Most estate and trust disputes do not begin with a challenge to a will or trust. They arise during the administration of the estate or trust. Delays, poor communication, conflicts of interest, compensation disputes, unequal treatment of beneficiaries, allegations of self-dealing, and disagreements over the sale or management of assets can quickly turn an otherwise straightforward estate or trust into costly litigation. Drawing on practical examples from across Canada, this session will examine the duties and responsibilities of executors and trustees, the most common administration disputes, and the steps beneficiaries and fiduciaries can take to avoid, manage, and resolve conflict before it escalates into litigation.
