US$1 billion claim at interlocutory defeated

In June of 2009 an amendment motion brought by a number of Plaintiffs against a client of the firm was dismissed. The motion for costs is pending. The case involved a claim of fraudulent misrepresentation and an allegation of unjust enrichment. The Plaintiffs sought to claim damages totalling just under $1 billion. Alex Kotkas, Peggy Grace, Karen Wyke, Casey Smith and Jennifer Shepherd of the firm's Calgary office were successful in obtaining the dismissal of the motion on numerous grounds.
