Fasken Martineau acted for the respondent, Texada Quarrying Ltd. (TQL) in the judicial review of two decisions regarding the proposed expansion of their coal storage and handling operation on Texada Island. The first of the two decisions was that of the Chief Inspector of Mines - Minister of Energy and Mines (MEM) to issue a permit amendment to TQL approving increase in coal storage. The second was the decision of the Minister of Environment, to not require TQL to obtain a permit under the Environmental Management Act for its operations. The chambers judge held that both decisions were reasonable and that there had been no breach of procedural fairness in making either decision.
