Fasken represented DP World Prince Rupert Inc. in a Fisheries Act prosecution against DP World, the Prince Rupert Port Authority, Fraser River Pile & Dredge (GP) Inc., and BelPacific Excavating & Shoring Limited Partnership, in relation to a Port expansion project in Prince Rupert.  DP World operates the Fairview Container Terminal located in Prince Rupert Harbour. The Crown laid 10 charges against the defendants, primarily for alleged breaches of conditions under the Fisheries Act Authorization obtained for the Project. The Total fines in issue were potentially in excess of $100 Million. DP World (Prince Rupert) Inc. was acquitted on all counts, with no fines or finding of guilt being made.
