Fasken represents The Avon Company Canada Limited and The Avon Company ("Avon") in connection with a class action proceeding by Avon retirees claiming that Avon breached its contract with them when it terminated their post-retirement benefits effective January 1, 2020. The plaintiffs seek a declaration that each member of the putative class is entitled to receive their post-retirement benefits (namely, a death benefit payable to the retiree’s designated beneficiary and extended medical benefits subject to a lifetime maximum) and that Avon is required to pay those benefits.
