A Southeast Asian telecommunications technology supplier commenced ICDR international arbitration in respect of a multimillion-dollar unpaid invoices dispute. Over the course of arbitration, the matter evolved into a complex and significant dispute involving issues of fraud, contract enforceability, fiduciary duties in a commercial context, and intellectual property and trusts law.
In a team led by Rahat Godil, which included Abbas Kassam, Fasken acted on this international arbitration, ultimately securing the client an award that included over C$20 million in damages, post-award disclosure and payment obligations for the respondent, and full costs. The arbitral award was subsequently upheld in the Ontario Superior Court of Justice.
