The Supreme Court of Canada annulled last spring's federal election result in a riding where a candidate was defeated by a single vote, thereby reversing the trial court’s ruling.
This exceptional decision stems from an irregularity involving a voter’s mail-in ballot that was returned by Elections Canada because of an incorrect address.
The written reasons for the judgment have not yet been released. Fasken argued that the irregularity affected the outcome of the vote and that ordering a by-election was necessary to protect the integrity of the electoral process. This is an unprecedented ruling in Canadian history.
Given this decision, Elections Canada will hold a new federal by-election to allow the citizens of Terrebonne to properly elect their Member of Parliament.
Fasken represented a candidate from the Terrebonne riding supporting the application to annul the election result, with a team composed of Chris Semerjian, W. Thomas Barlow, KC, Marie-Eve Labonté, Catherine Simonet, Gabrielle Gagnon and Olivia Desgroseilliers.
