Canadaland podcast host makes in-court apology to Theresa Kielburger as part of settled defamation case

Fasken acted for Theresa Kielburger, the mother of WE Charity co-founders, in the prosecution of a defamation action in respect of a Canadaland podcast episode produced by journalist Jesse Brown. 

Fasken successfully represented Ms. Kielburger in resisting an anti-SLAPP motion by the defendants Mr. Brown and Canadaland Inc. (the anti-SLAPP motion by journalist Isabel Vincent, who participated in the podcast, was allowed), and obtained substantial indemnity costs against the unsuccessful defendants.

In what is believed to be a first in the Canadian context, Ms. Kielburger subsequently obtained an open-court apology and retraction as part of the settlement of the action, in addition to significant damages.
