What should we be looking at in litigation right now? “The provisions of the new Code of Civil Procedure are still vague, and there still isn’t much jurisprudence, acknowledges Me Ang. Judges are therefore open to new arguments that might be raised by litigators.”

According to Me Semerjian, the greatest challenge for litigators is to maintain the best possible relationship with the client. “Contrary to our corporate law colleagues, for example, we are called in when things are going badly! In such circumstances, it is vital to maintain a good relationship with the client, to ensure that the client understands every step in the process,” he explains.

“The greatest advantage with this appointment is the credibility it offers, especially with older clients,” confides Me Robitaille to Droit-inc. “Relationships are easier with younger people, but the title of partner might be enough to reassure a client over 60, for example.”
