FMD represented Hollinger to petition the court to re-open a consent order in order to hold former directors accountable for allegedly inappropriate benefits. FMD succeeded in obtaining a trial of the issue as a result of aggressive evidence gathering and by extending Canadian law on director oversight and the finality of consent orders with corporations instructed by directors with self-interest in the consent order.
