​FCA has retained our firm to represent it in numerous putative class action proceedings respecting the diesel fuel emission systems in two models of FCA vehicles.  The plaintiffs allege that the emission systems in these vehicles are designed in such a way as to perform differently under regulatory testing conditions than in real life operation, with the result that the vehicles met regulatory testing requirements but then emit more diesel emissions when operated in real life. FCA denies all of these allegations.  The putative class actions were launched in Ontario, Quebec and BC. This is very important litigation. It is very high profile, and has received a substantial amount of media attention. In addition, the motion for  a stay of the Quebec proceeding that we brought on behalf of FCA has developed in a unique and novel manner, and may set a new legal precedent in Quebec (the motion decision is currently under reserve).  These putative class actions are ongoing.
