Fasken is representing Air Canada in a class action filed against it on behalf of both disabled individuals and those with a functional disability related to obesity who faced extra charges for seats adapted to their condition. This class action is in response to a decision of the Canadian Transportation Agency that required modification of tariff policy of air carriers.
This unprecedented case relates to the liability of air carriers and the discriminatory nature of their pricing policies, the impact of decisions made by an administrative body and the enforcement of Canadian laws protecting human rights.
A Fasken team composed of Marc-André Fabien, Christian Trépanier and Maxime-Arnaud Keable represented Air Canada in connection with this class action.
