On September 26, 2016, Hôtel Clarendon Inc. won its case and obtained confirmation of the validity of its right of first refusal to a building.

In Case no. 200-17-024029-167, the Superior Court recognized that Hôtel Clarendon Inc. had a right of first refusal which had been granted several years earlier and which was still valid despite (i) a corporate merger of the beneficiary, (ii) the sale of the beneficiary’s business and (iii) the transfer of the building by the debtor to an affiliated company.
