Karen Sargeant, Rachel Younan and Gillian Round successfully defended Air Canada against allegations that it was precluded from terminating the employment of bargaining unit employees who had been determined to be totally disabled pursuant to the Group Insurance Disability Income Plan and where there was no reasonable prospect of such employees returning to work and maintaining regular attendance in the foreseeable future because of disability.
