Heidelberg Materials Canada Limited, a global producer of aggregates, cement, and ready-mix concrete with operations across British Columbia, was involved in a lengthy labour dispute at its Delta Cement Plant that became one of the province's most significant labour relations matters in 2025.
Fasken represented Heidelberg throughout the more than 11-month strike and related proceedings before the British Columbia Labour Relations Board and the courts. The team successfully defended the company against replacement worker and ally complaints brought by the union, managed numerous Labour Board applications arising from strike activity, obtained a British Columbia Supreme Court injunction to prevent unlawful picketing and maintain safe access to the facility, and provided ongoing bargaining strategy and risk management advice.
The matter generated extensive litigation and significant media attention due to its duration, complexity, and impact on industrial operations. Fasken's strategic labour relations and litigation support helped Heidelberg navigate a challenging labour dispute and ultimately negotiate a favourable collective agreement.
