Overview

In February 2024, a Fasken team represented a media coalition that included CBC/Radio-Canada, Toronto Star Newspapers Limited, La Presse inc., CTV, Global News, MédiaQMI inc. and Groupe TVA inc. before the Public Inquiry into Foreign Interference in Federal Electoral Processes and Democratic Institutions (Hogue Commission).

The Media Coalition’s participation aimed to promote transparency and public access to the Commission’s work. Among other things, the Coalition argued that the Commission should limit in-camera hearings as much as possible and provide the public with access to documentary evidence and testimony to the fullest extent consistent with national security requirements.

The Coalition also requested that the Commission conduct its own assessment of the confidentiality claims rather than relying on the classification level assigned to the documents by the government, and seek to maximize public disclosure, including through targeted redactions and summaries of in-camera testimony.

Christian Leblanc and Patricia Hénault represented the Media Coalition in these proceedings.
