Johan Coertze is a Partner at Fasken. Johan is in the Corporate and Commercial Practice Group specialising in tax. He is part of the team that advises clients on direct and indirect taxation matters relating to corporate and business law.
Johan’s main focus is advising on the tax aspects of local and international commercial transactions, including internal and external restructuring, mergers and acquisitions, preference share funding as well as once-off transactions by listed and unlisted clients. He regularly advises clients with regard to the South African Exchange Control Regulations and assists clients in obtaining exchange control approval from the Financial Surveillance Department on both inward and outward investments.
Johan assists both local and international clients with tax dispute resolution processes including drafting objections and conducting appeals. In addition, he advises on procedural aspects of tax statutes including reviewing decisions of the commissioner and enforcing taxpayers’ rights. Additionally, Johan assists clients in applying for public benefit organisation status and the various aspects ancillary to such approval as well as assisting clients with any disputes that arises.
Johan is part of the team that has drafted submissions to National Treasury on various tax legislative changes.
