Ottawa Partner, and Chair of Fasken’s International Trade and Investment Group, Clifford Sosnow, comments on a ruling by the US appeals court declaring that many of the tariffs imposed on dozens of countries by President Donald Trump are illegal, in an article published in the Financial Post.
He explains that the tribunal’s decision creates confusion in jurisdictions where new trade deals have been struck with the US—such as the United Kingdom, European Union and China—because each was based on tariffs imposed using emergency powers, such as the one that was struck down by the court.
