Toronto Partner, and Leader of Fasken’s Global Infrastructure & Projects Group, Ella Plotkin, comments on the importance of risk-sharing between governments and the private sector, as well as the establishment of clear rules, as critical to the success of Canada’s next wave of infrastructure projects, in an interview published in Canadian Lawyer.

Noting that historically the presence of private capital in P3s has led to successful long-term projects, Ella Plotkin, who is also Vice Chair of the Board of Directors of the Canadian Council for Public Private Partnerships, advises policy-makers and procuring agencies to take the measures required to secure those investors.

“Make sure you do what it takes to bring the private capital on board. And if it means putting in the public capital or the guarantees or taking on more risk in certain projects than you might have traditionally done, do that to bring the private capital on board because they will bring in the expertise, the oversight. It’ll create the right incentives for the projects to succeed,” said Partner Ella Plotkin.
