The plaintiffs claimed from Navistar Canada Inc. a total of nearly C$7 million for reimbursement of the sale price of trucks sold and miscellaneous damages, including lost profits.

The Court of Appeal (Case no. 500-09-024367-146) dismissed the plaintiffs' motion for leave to appeal a Superior Court judgment ordering them to disclose to Navistar Canada Inc. their internal year-end financial statements, their annual consolidated and unconsolidated financial statements and the details of the general ledgers for all of the past ten fiscal years.

Dave Robitaille represented Navistar Canada Inc. in this case.
