In May 2016, the plaintiff demanded transfer of ownership of a parcel of land historically used by our client, but located on the neighbouring lot. Our investigation with the municipality allowed us to reveal an unpublished servitude by destination of the owner which justified our client's use under articles 1181 and 1183 of the Civil Code of Québec.

Our research consequently allowed us to negotiate a very favourable settlement putting an immediate end to the litigation. This decision was essential for our client since this parcel of land was necessary for the operation of her hotel activities.
