Participation in the Coderre v. Michaud case in which the Firm's representations before the Superior Court led the Court to set aside, to the benefit of our clients, an adjudication rendered as part of major commercial arbitration. This was a landmark decision in that it specified the checks imposed on the powers of commercial adjudicators, particularly when they are acting as amiable compositeurs. This judgment was upheld by the Court of Appeal in a landmark decision that has since become case law (J.E. 2006-122 (C.S.), [2008] R.J.Q. 1245 (C.A.)).
