Recent cases have highlighted the extent to which royalty interests will be protected in insolvency proceedings, including the means by which to properly document such agreements to ensure they are protected. We will also discuss the direction we believe the courts are going in terms of ultimate resolution of this contentious issue.
From recent experience, we are familiar with various options and procedures for effecting successful debt recapitalization transactions, both under insolvency legislation and corporate legislation. We intend to explain the process, timing and ultimate results to be achieved for the benefit of the companies themselves.
