Overview

Erika advises on regulatory matters in the transportation sector, including the transportation of passengers and cargo by air, rail, sea and road, as well as in the construction sector.

Erika assists clients in navigating regulatory frameworks, contractual agreements and the common law to meet their business needs. She has acted for and advised Canadian and international:

  • air carriers and air operators;
  • railway companies;
  • motor carriers;
  • industrial equipment and consumer product manufacturers and suppliers;
  • transportation logistics and maintenance companies;
  • infrastructure contractors, developers, and engineers;
  • airport authorities;
  • crown corporations;
  • investors; and
  • insurers.

Her practice is wide reaching and includes operational compliance, licensing and permitting in the context of mergers and acquisitions, transportation and workplace incidents and fatalities, infrastructure projects, dispute resolution, litigation, and regulatory proceedings.

She is experienced with federally, provincially and municipally regulated matters, with an emphasis on matters within the jurisdiction of the Canadian Transportation Agency, Transport Canada, the Transportation Safety Board of Canada, and provincial technical safety authorities.

Erika has acted as counsel and contributed in proceedings before the Provincial Court of British Columbia, the Supreme Court of British Columbia, the British Columbia Court of Appeal, the Ontario Court of Justice, and numerous tribunals, including the British Columbia Civil Resolution Tribunal, the Ontario Criminal Injuries Compensation Board, the Workers’ Compensation Board of British Columbia, and the Insurance Council of British Columbia, among other tribunals.

Erika takes a thorough and measured approach to resolving disputes, advocating in proceedings, guiding through regulatory regimes, and advising on contractual agreements.
